Access to this information is available free of charge. The Company does not verify this information and does not guarantee the accuracy, completeness, or timeliness of the information or claims contained therein. The Company uses reasonable efforts to keep the information contained on The Website current, but it assumes no liability to do so, and acknowledges no responsibility or liability for any misrepresentations, errors, or omissions that might appear on the Website's pages.
- Individual massage therapists or other service providers and advertisers may make certain claims of specialty, experience, licensing or competence within their listing on The Website. No such claims have been investigated or confirmed by The Company. Most states and some municipal governments require massage therapists to acquire licenses before practicing their trade within the jurisdiction. The Company does not in any way endorse, guarantee or warrant the licensure, qualifications or abilities of any individuals or businesses appearing on The Website, nor does it guarantee or endorse the quality or efficacy of any services or products offered thereby. By utilizing The Website's directory, you understand that you are responsible for confirming the qualifications of any provider you may choose, and for determining the appropriateness of any service or product that is offered.
- The general operation, features and layout of the website is subject to change by Steel Oats Media Pty Ltd at any time. Changes are effective when posted on this site without notice upon each member, unless directly affecting advertising membership levels.
General Use
- The Company authorizes You to view and access a single copy of the content available on or from the Web Site solely for your personal, noncommercial use.

Unauthorized use of the Web Site Content may violate copyright, trademark, and other laws.

- Using the massageguys database for any purpose other than as a massage therapy patron seeking a massage therapist, including but not limited to using the information in the Database to sell or promote any products or services.
- Sending unsolicited mail or e-mail, making unsolicited phone calls or sending unsolicited faxes regarding promotions and/or advertising of products or services to a listed massage therapist on the Web Site. Deleting or revising any material posted by any other person or entity.
- Using any device, software or routine to interfere or attempt to interfere with the proper working of the Web Site or any activity being conducted on this site.
- Taking any action which imposes an unreasonable or disproportionately large load on any the Web Site's infrastructure
- Aggregating, copying or duplicating in any manner any of the Web Site Content or information available from the Web Site.
- Framing of or linking to any of the Web Site Content or information available from the Web Site.
Membership and Site Use
This information relates to site users and registered memebrs.
General
- When You register for the Web Site, You will be asked to provide the Company with certain information including, without limitation, a valid email address (your Information ),age (18+). The Company will not disclose to any third party your name, address, e-mail address or telephone number without your prior consent, except to the extent necessary or appropriate to comply with applicable laws or in legal proceedings where such information is relevant.
- MassageGuys.com.au has established a Privacy Policy to explain to users how their information is collected and used, a link to this privacy policy can be found at the bottom of every page on the site.
- As a user, you are responsible for your own communications and are responsible for the consequences of your posting.
- The Company does not represent or guarantee the truthfulness, accuracy, or reliability of communications posted by users or endorse any opinions expressed by users. You acknowledge that any reliance on material posted by other users will be at your own risk.
- IT IS SOLELY THE RESPONSIBILITY OF THE SITE USER TO CHECK VALIDITY OF CREDENTIALS, STATUS AND PROFILE DETAILS OF ANY MASSEUR OR BODYWORKER THAT THEY WISH TO HIRE.
Limited Liability
- BY SUBMITTING MATERIAL TO A PUBLIC AREA, YOU AGREE TO INDEMNIFY THE COMPANY AND HOLD IT HARMLESS FROM ANY AND ALL CLAIMS, INCLUDING, WITHOUT LIMITATION, CLAIMS FOR LIBEL, SLANDER, INVASION OF PRIVACY, COPYRIGHT INFRINGEMENT OR OTHERWISE, ARISING FROM SUCH SUBMISSION.
- The Website contain advertisements and communications (the “Content”) that are created and posted by independent third parties (the “Advertisers”). As a result, MassageGuys is not responsible for, nor will it facilitate communication with, act as an intermediary, or be involved with in any way, any communications or disputes arising between the User and an Advertiser.
- The Company has no liability or responsibility to users for performance or nonperformance of any advertised service.
- The Company reserves the right to expel users and prevent their further access to the Web Site for violating the Terms and Conditions or the law and the right to remove communications which are abusive, illegal, or disruptive.
- The Company may take any action with respect to user-submitted information that it deems necessary or appropriate in its sole discretion if it believes it may create liability for the Company or may cause the Company to lose (in whole or in part) the services of its web hosting company or other suppliers.
- By submitting images to any public area of the Web Site, including profiles, You grant the Company and its affiliates the loyalty-free, non-exclusive right (including any moral rights) and license as long as you are a subscriber of the Web Site to use, reproduce, modify, adapt, publish, distribute, communicate to the public, and display the images (in whole or in part) worldwide for the purpose of promoting the Web Site and its services. - This site may not be used for advertising of any sexual services or for advertising for services that engage in activities requiring the payment of money for sex or other illegal activities.
- This includes phrases or certain types of bodywork that may allude to, or reference any kind of service, that can be interpreted as sexual in nature. Content may be denied at the discretion of our support staff.
- We do not take responsibility, or generally get involved in negotiations between masseurs and clients outside of our online presence. We are responsible for advertising content only, inline with our terms and conditions.
- Providers, either independent or businesses, must be legally able to conduct business within Australia, and must be conducting such business on Australian soil.
- We may, at anytime, request proof of legal work status within Australia. Foreign profiles, or providers that fail to provide this evidence, will be suspended without refund.
- We may, at anytime, request verification of profile photos and/or previously uploaded picture ID. Providers that fail to provide this evidence, will be suspended.
- Photo IDs or proof of work documents are removed from our server after profile verification or within 30 days, which ever comes first.
- Only one profile/account is allowed per individual or business. Active accounts must be operated by the account holder.
- One account is deemed to include all active, inactive, paused or suspended accounts.
- Accounts cannot be transferred or used by another individual or business.
- We do not allow Queensland members to advertise 4 hand massage, or for multiple masseurs to advertise from the same business location.
- Profiles found 'Prohibited Uploaded Content' will be edited, or the account suspended at our discretion.
- All written content must adhere to our full terms and conditions.
Acceptable Service Rates
- Single masseur 60 min incall - $180 max.
- Outcall, 4 hands, and other massage time frames will be indexed on these rates.
- Profiles found with higher rates may be edited and/or suspended
User Uploaded Content
By uploading any photos or other material, you warrant that the uploaded photos or materials do not infringe upon any patent, trademark, trade secret, copyright or other proprietary rights of any party. You further warrant that you have a right to make available the photos or materials under law or contractual relationships.
Uploading photos or materials that are found to infringe upon the proprietary rights of another party may result in the deactivation or deletion of your account.
All our decisions regarding photo eligibility are final and non-negotiable.
Requirements for Uploaded Content
- Ensure your content is professional and directly related to your therapeutic/relaxation massage service.
- Limited referencing to sensual services as part of your massage service is allowed.
- Profiles without valid content will not be displayed.
- Ensure that your text complies with the laws in your state.
Requirements For Uploaded Images
- Images should be professional and of adequate resolution.
- Lower Body - Full coverage with loose fitting shorts.
- Torso - Full coverage, minimum of a tank top / singlet.
- Only the massage therapist (and massage partner if applicable) can appear in the photo.
- For independent accounts, a massage partner cannot be designated as the primary photo.
- Client/Model must be fully covered with a towel, and you cannot show their face due to privacy restrictions.
- Photo verification will be required after initial photo uploads for new accounts, or if you were required to upload a photo ID.
- Photo re-verification may be required at our request.
- Only one (1) business image with overlaid (business card) detail - Business logo, business name and phone number.
Prohibited Uploaded Content
- Any type of service that is not an allowed service.
- Language that is suggestive, alludes to, or directly offers services other than allowed massage services.
- Any type of nude service.
- Information that is unrelated to allowed massage services.
- References to additional services. You can say "Contact me for more information".
- Discrimination language, including requesting client photos prior to booking.
- Any use of the word 'Boy' or similar phrase, or suggesting under 18 years of age.
- Referencing degree qualified techniques or services without documented qualifications.
Prohibited Images
- Copyrighted photos or images that are not your intellectual property and copyrighted by a third party.
- Stock photography will not be considered your intellectual property.
- Unprofessional images. Images that our AI filtering services identify as inappropriate, unrelated or unprofessional.
- Fake or inaccurate images.
- Other People or parts thereof.
- Uncovered or inadequetly covered Clients/Models
- All clipart, abstract photography or animations.
- Images of anyone under the age of 18.
- Photos with animals.
- Laying in any position indoors or outdoors.
- Text message, Email or App Screengrabs.
- Photoshop overlays.
- Face blurring or similar.
Certifications Images
- Screenshots of certifications or Covid vaccination status etc are permitted.
- Documents must not be altered in any way
- The document clearly shows the first and last name
- The name on the document matches the legal name associated with the massage guys account
- The document is relevant to the services offered on the massageguys website.
- Cropping your face from your photo is permitted
Links and External Websites
- The Web Site may contain links to third party web sites that are approved by the site administrator. These links are provided solely as a convenience to You and not as an endorsement by the Company of the contents on such third-party Web sites. The Company is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third party Web sites. If You decide to access linked third party Web sites, You do so at your own risk.
- Linking to any site that is categorised as porn, offers escort services, paid sexual services, or other sexual related services is strictly prohibited.
- Members may only link to approved websites, that they own, or to approved scheduling websites for their serives. Other website links will be removed.
- Websites that link to a direct competitors main website may be removed.
Tax Invoices & Legal Name
Generally we need to provide you with a receipt of purchase by law. When we make a taxable sales of more than $82.50 (including GST), our GST-registered masseurs need a tax invoice.
If a masseur asks us for a tax invoice, we must provide one within 28 days of their request.
Tax invoices must include at least seven pieces of information as listed below:
Tax Invoices
- The document is intended to be a tax invoice
- The seller's identity
- The seller's Australian business number (ABN)
- The date the invoice was issued
- There is a brief description of the items sold, including the quantity (if applicable) and the price
- There is a statement such as 'Total price includes GST'
- In certain cases the buyer's identity or ABN is required
Independent Contractors
- Masseurs are independent contractors merely purchasing a service from the company.
- The company does not employ masseurs, but simply sells them advertsing space.
- The company will supply with tax invoices/receipts to conform to the law.
- The company does not share membership details nor does it collect tax from members.
- Independent contractors tax obligations, and how they manage them, are their own affair.
Legal Name
- Your legal name is reguired on sign up
- We need this to confirm identity and for tax invoices, legal work status, and to help in the prevention of human trafficing.
- Accounts using fake names or identity will be suspended immediately.
Terminated, Suspended, Closed Accounts
Disclaimer
- If you pay for advertising services on the Site, The Company reserves the right to suspend your subscription for any reason, at any time.
- If your membership is terminated by the Company prior to the expiration of your current prepaid subscription plan, due to reasons other than a breach of these terms and conditions, you will be provided a prorated refund.
- If your membership is terminated by the Company prior to the expiration of your current prepaid subscription plan, due to a breach of our terms, you will not be provided a prorated refund.
- You agree that the site shall not be liable to you for any termination of your access to any part of the site. You agree that if your access is terminated by us, you will not attempt to regain access to the site, using the same or different username, without prior approval from us.
Termination due to:
- Failure to adhere to any of our terms and conditions.
- Advertising any type of escort services.
- Repeated negative feedback.
- Not providing the service that was advertised. This includes time, service type, cost, unprofessional behaviour - requires supporting proof (police report or similar).
- Providing false or misleading information on registration or in the masseur profile
- Illegal activities of any kind, with supporting police report or similar.
- Fraudulently using any of the member features such as travel calendar or testimonials.
- Repeated support related issues such as bad language, insults, discrimination or ongoing refusal to accept our decisions as per terms and agreements.
- Failure to verify your profile at the request of the company. Verification photo requests are for identification purposes and to remove sensitive photo ID form our server.
Temporary Suspension due to:
- Any of the reasons listed in 'Termination'.
- An account with a negative balance.
- Continued failure to make payments and submit 'notify us form' on the same calendar day.
- Breach of any of our terms and conditions
Closing an Account
- Members can close their account at any time
- To close an account the member must be signed in and request closure via the account menu.
- Members can request a refund of any outstanding account balance.
Refunds
- Steel Oats Media Pty Ltd will also offer refunds of fees, in matters where the payment method was subject to unauthorized or fraudulent use; or the Member did not have the ability to access the site, for a period of longer than 48 consecutive hours, using a valid e-ticket provided by Steel Oats Media Pty Ltd
- Refunds will not be offered or issued in situations where an account has been blocked/removed by site administrators for suspicious or fraudulent activity.
- When the member requests the termination, the member can request the remaining account balance (in AUD dollars) are refunded within 30 days.
Billing
Definitions
- 'Member' or 'Membership' as referred to in this document shall mean: The member or user of a valid username and password (e-ticket) for the site during the term of membership.
- 'Site' as referred to in this document shall mean: The website for which you are purchasing a username and password (e-ticket) from Steel Oats Media Pty Ltd in order to access the site and its materials and obtain the benefits of membership.
- 'E-ticket' as referred to in this document shall mean: The combination of unique username and password that is used to access a site. An e-ticket is a license to use a site for a period of time that is specified.
- Steel Oats Media Pty Ltd will provide one e-ticket to access the site and its contents for which you are purchasing membership. E-tickets are only available to Australian legal residents or visitors that have a vaild work permit.
- Members may not under any circumstances release their e-ticket to any other person, and are required to keep their e-ticket strictly confidential. Steel Oats Media Pty Ltd will not release passwords for any reason. Unauthorized access to the site is a breach of this agreement and a violation of law. Members acknowledge that the owner of the site may track through the use of special software each member's entry to the site.
- Steel Oats Media Pty Ltd, or a variation of this, will appear on your credit card, bank statement, or phone bill for all charges made.
- All transactions are processed in Australian Dollars (AUD) and include GST (Goods and services tax)
- Sites use daily fees that are defined by the owners of the site at the time of the initial enrollment for subscription. The member is responsible for such fees according to the terms of the site.
Payments
- Steel Oats Media Pty Ltd DOES NOT use Automatic Recurring Billing not do we accept credit card payments.
- The member can purchase a minimum of $30 and inrecemtns of $5 therafter.
- The members account balance can be used for daily access fee, platinum add-ons and other paid-for-use features.
- We do not support notifying of future payments. The 'notify us form' and payment must be completed on the same calendar day. Repeat offenders may be suspended.
- We do not split payments between members.
- Accepted payments are BPay, electronic funds transfer and direct deposit at a Westpac branch.
- The daily fee deducted per day will depend on the member level (platinum/gold/silver/bronze) at the time of deduction. Fees for each level are listed on the site and at sign up.
- Pausing or changing levels will not effect daily fees already deducted for that day. There will be no balance adjustment for memberships that change levels or resume from being paused.
- Changing levels - A level change request will remain pending until the end of the current day billing cycle. At the start of the new days billing cycle, the new level will be activated, and the daily fee deducted at this new level.
- The member can choose to suspend or pause their membership for up to 60 days. After this time the membership will become active again. There may be a blackout period applied after resuming.
- Members who have an insufficient balance will have an inactive status, and their profile will be hidden on the site until such times as the member has a sufficent balance for the requested daily fee.
- For accounts in good standing, payments we receive will be pre-approved within 2 hours of receiving the 'notify us form'.
- Payments we receive will require at least one (1) business day to fully clear.
- For suspended accounts, payments we receive will not be pre-approved and must wait for the payment to be fully cleared.
Electronic Receipt
- Receipts and balance updates are delivered electronically. There is no shipping or shipping costs involved in this delivery.
- Transaction details are stored securely on our server.
- Members may, at any time, review and print their transactions/tax invoices from their account page.
Testimonials
General
- Members information is confidential as per our privacy agreement. We cannot give out member information to other users.
- We (site administrators) read all testimonials and decided if they should be approved based our general terms and conditions.
- Our decision on whether a testimonial is approved, is at our discretion. and all decisions are final.
- A member can only write a testimonial for an individual masseur once.
- We (the company) do not edit, change or modify testimonials under any circumstanses.
- We have an opt out option for the testimonial system allowing masseurs to completely opt out of the system
Posting
- Only registered site users can post a testimonial, masseurs cannot post testimonials.
- Any masseur found to be writing testimonials will be banned from the testmonial feature
- Testimonial comments must contain relevant information about the massage. One line testimonials may be denied at our discretion.
- Testimonials must adhere to our site terms and conditions for posting content.
- A Testimonial will not be shown on the site until it has been approved by our administrative staff and by the masseur.
- All testimonials will have a status of "Approved", "Denied" or "Pending.
Grounds for Denial
- The testimonial mentions or eludes to a sexual service.
- The testimonial uses terms that do not adhere to our terms and conditions.
- Rude or inappropriate language.
- One line testimonials.
- The testimonial is a duplicate or fraudulently placed.
- The testimonial uses terms or phrases that are considered derogatory, defamatory or discriminatory
- Testimonials that are denied will not appear on the site.
Options
- If approved, the comment portion from your review will be automatically shown on your profile as a testimonial.
- Members can approve or deny individual testimonials via the testimonials page.
- We provide an option in the SETTINGS TAB to opt out of the testimonial system completely.
Indemnity & Liability
You agree to defend, indemnify, and hold harmless the Company, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from (1) any material You provide to the Web Site, (2) any Web Site Content that You use/upload or (3) your breach of the terms of these Terms and Conditions.
Liability
- massageguys.com.au is only a venue. This Web Site acts as an advertising venue for massage therapists and bodywork professionals to post advertisements and does not screen all aspects of the listings offered. The Company is not involved in the actual transaction between massage therapists and potential clients. As a result, the Company has no control over the quality, safety or legality of the advertisements posted, the truth or accuracy of the advertisements, or the skills of the massage therapists. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers. You assume all risks associated with dealing with other users with whom You come in contact through the Web Site.
- Because user authentication on the Internet is difficult, the Company cannot and does not confirm that each user is who they claim to be. Because we do not and cannot be involved in user-to-user dealings or control the behavior of participants on the Web Site, in the event that You have a dispute with one or more users, You release the Company (and our agents and employees) from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
- We are under no legal obligation to, and generally do not, control the information provided by other users which is made available through the Web Site. By its very nature, other people's information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled.
- The Web Site Content may contain inaccuracies or typographical errors. The Company makes no representations about the accuracy, reliability, completeness, or timeliness of any Web Site Content. The use of the Web Site Content is at your own risk. Changes are periodically made to the Web Site and may be made at any time.
- You acknowledge and agree that You are solely responsible for the form, content and accuracy of any advertisement contained therein placed by You on the Web Site.
- The company does not warrant that the website hosting company will provide 100% uptime. There may, from time to time, be technical issues with the server that is beyond the control of the company. The company does not offer a refund for downtime caused by these server related issues.
- You agree not to resell or assign your rights or obligations under these Terms of Use. You also agree not to make any unauthorized commercial use of the Web Site
- THE COMPANY DOES NOT WARRANT THAT THE WEB SITE WILL OPERATE ERROR-FREE OR THAT THE WEB SITE AND ITS SERVER ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF THE WEB SITE OR THE WEB SITE CONTENT RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, THE COMPANY IS NOT RESPONSIBLE FOR THOSE COSTS.
